Q. What is an FFL and who needs one?

A. An FFL is a federal firearms license required due to federal regulations set out in the Gun Control Act of 1968 and other firearms legislation. An FFL is NOT the same as a gun permit or license to carry, use or possess a firearm. An FFL allows a person to conduct a business that sells firearms or repairs firearms. An FFL allows a person to be a firearms dealer, pawnbroker, gunsmith, firearms or ammunition manufacturer, or importer of firearms.

Q. Ive heard that there are different types of FFLs. What kind should I get?

A. Actually there are eleven types of federal firearms licenses and each type is very specific in its scope and what it allows. A particular business operation may be required to have more than one type of FFL. Generally people who want to be gun dealers, buying guns typically at wholesale and reselling them, will need a Class 1 FFL. A Class 3 FFL applies to those who qualify as collectors of curio or relic (C&R) firearms as defined by federal firearms regulations, typically guns manufactured over 50 years ago.

Q. How do I get an FFL?

A. On the surface, getting an FFL is as simple as filling in the required application and submitting it to the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) which is a branch of the U.S. Department of Justice. That being said, an FFL confers a lot of privileges to conduct business in a highly regulated industry so the application is complicated. Applicants must prove that they meet all the applicable federal, state and local regulations and requirements. Know in advance that ATF agents thoroughly check and verify all information submitted on the application. The application process also includes an on-site visit by an ATF agent and an interview with all applicants to make sure they understand the federal regulations.

Q. Can anyone apply for an FFL?

A. No, there are restrictions that prohibit some individuals from being considered for an FFL. The applicant must be 21 years of age or older and otherwise eligible to possess a firearm. For example, convicted felons are prohibited from possessing firearms. Applicants who are on record as violating any part of the Gun Control Act will be rejected for an FFL.

Q. Is it easy to get an FFL?

A. Well, the answer to this question is it depends. A person who fills in the application paperwork properly by answering all the questions truthfully and providing all the required information as well as passes the face-to-face interview with an ATF agent has a good chance at receiving an FFL on the first attempt.

Q. What happens if my application is denied?

A. Federal firearms regulations allow a person to appeal the decision of the ATF to deny the FFL application. Even if the application is originally denied, an applicant may later be approved by showing compliance with any item in question on the application. The best approach is to do everything right the first time.
